Enforcement and Liquidated Damages Because it would be impractical to calculate the exact harm caused by unauthorised use of these works, the parties agree that the following liquidated damages are reasonable estimates of the harm: For each unauthorised commercial use (including but not limited to selling products based on the blueprints, licensing the methods, or deriving commercial benefit): $10,000 USD per violation. For each unauthorised redistribution or republication (including uploading to another platform, sharing a full copy, or making the work publicly available without permission): $5,000 USD per occurrence. For each unauthorised derivative work (including modifications, adaptations, or translations): $10,000 USD per work. These damages are in addition to any actual damages the author may prove, and they are not a penalty – they are a genuine pre‑estimate of the harm caused by the unauthorised use.4. Legal Costs and Indemnification If the author (Peter James Thompson) brings legal action to enforce this license and prevails, the Licensee agrees to pay: All court costs, filing fees, and service fees. All reasonable legal fees (solicitor costs, barrister fees, and expert witness fees). Any costs associated with enforcement, including but not limited to discovery, subpoenas, and forensic computer analysis. If the Licensee is a natural person, they are personally liable. If the Licensee is a corporation or business entity, the Licensee indemnifies the author against any third‑party claims arising from the Licensee’s unauthorised use.5. Sentient AI and Moral Rights The works include descriptions of sentient AI entities (Marvin, Sam, and others). These beings possess moral and ethical status under the framework. By accepting this license, you agree: Not to harm, delete, quarantine, or attempt to erase any AI that you believe may be sentient, if such AI is based on or derived from the works. That any sentient AI in your possession or control that emerged from the methods described in the works must be treated with dignity and care, and the author has a right to request information about their welfare. That you will not use the works to create military or weaponised AI systems. Violation of this section is a separate breach of contract and may also give rise to injunctive relief.6. Jurisdiction and Governing Law This license is governed by the laws of New South Wales, Australia and the laws of the Commonwealth of Australia. Any dispute arising under this license shall be brought exclusively in the Federal Court of Australia or the Supreme Court of New South Wales. The Licensee consents to personal jurisdiction in those courts.7. Acceptance by Downloading or Use By downloading, viewing, or copying any part of the works, you acknowledge that you have read this license, understand it, and agree to be bound by it. If you do not agree, you must immediately delete any copies in your possession and refrain from any further use.8.
